1. Scope
1.1
These General Terms and Conditions (GTC) apply to all business relationships between Rotau Organic Shop KLG (hereinafter «Rotau.ch») and its customers (hereinafter «customer») for orders placed via the online shop at www.rotau.ch. By submitting an order, the customer accepts these GTC without reservation and accepts their exclusive applicability. General terms of business, purchasing or other conditions of the customer do not become part of the contract, even if Rotau.ch does not expressly object to them.
1.2
Rotau.ch reserves the right to amend these GTC at any time. The version of the GTC published on the website at the time the order is received applies to each order. There is no subsequent unilateral amendment of the GTC governing a specific order.
1.3
Deliveries are generally made exclusively to addresses in Switzerland. Delivery abroad is only possible after prior individual arrangement with Rotau.ch and express clarification of the costs incurred.
1.4
The presentation of products in the online shop constitutes a non-binding invitation to order. A contract is only concluded once the order is accepted by Rotau.ch. The offer applies as long as the product can be found in the online shop and stock is sufficient. If an ordered item is not available, the customer will be informed promptly and any payments already made will be refunded.
1.5
Rotau.ch is entitled to reject orders in quantities not customary for a household or in case of insufficient stock availability without giving reasons, or to make the fulfilment of the contract dependent on adjusted conditions. Separate, individually agreed conditions apply to commercial resellers and B2B customers.
2. Customer account, registration and data
2.1
Customers are free to place orders as a guest without registration or via a personal customer account. The data required for processing the order must be provided completely and truthfully. The customer is obliged to keep their data (in particular delivery address, email, payment information) up to date and correct at all times.
2.2
When using a customer account, data changes can be made independently in the account. The access data (username, password) must be treated confidentially and protected against access by unauthorised third parties. In case of suspected misuse of the account or unauthorised use of the access data, Rotau.ch must be informed immediately.
2.3
Rotau.ch reserves the right to block or close customer accounts without prior notice, in particular if there is a violation of applicable law, these GTC or other guidelines of Rotau.ch. In the event of an account closure, the customer will be notified insofar as this is legally permissible.
3. Product prices and shipping costs
3.1
All product prices stated on www.rotau.ch are in Swiss francs (CHF) and are total prices. As a small business pursuant to Art. 10 of the Swiss VAT Act, Rotau.ch is exempt from value added tax; the displayed prices are therefore understood to be exclusive of VAT. Shipping costs are not included. Any costs for customs clearance and import taxes are shown separately or are to be settled in accordance with section 3.4.
3.2
The prices and shipping costs stated on the website at the time the order is received are decisive. For private customers (B2C), shipping costs are waived from an order value of CHF 80.- for orders up to 10 kg. Orders with a total weight of 10 kg or more are considered a large parcel and are charged at a flat rate of CHF 22.00; the free-shipping threshold does not apply to large parcels. For commercial customers (B2B), shipping costs are waived from an order value of CHF 500. For B2B orders placed via the online shop, the shipping costs displayed may differ from the shipping costs actually charged; the correct shipping costs are shown in the final invoice amount.
3.3
Before you bindingly submit your order, all applicable product prices, shipping costs and any surcharges will once again be clearly displayed in the order summary on www.rotau.ch. For commercial customers (B2B), the shipping costs displayed in the online shop may differ in the final invoice amount in accordance with section 3.2.
3.4
No additional import duties or import taxes apply to deliveries within Switzerland. For deliveries to other countries – which are only made after prior individual arrangement in accordance with section 1.3 – additional import duties, taxes and processing fees of the customs authorities may apply. These are levied directly by the responsible national authorities upon arrival of the shipment and are to be borne by the customer.
3.5
Rotau.ch may occasionally employ technical marketing measures in the online shop in order to offer personalised prices or discounts based on automated or manual decision-making. In such a case, the customer will be expressly informed of the personalisation in the offer.
3.6
Rotau.ch reserves the right to change the prices of the products and services offered at any time. The price valid on www.rotau.ch at the time of the order is decisive for the conclusion of the contract.
4. Pickup (self-collection)
4.1
Rotau.ch does not operate a public store with fixed opening hours. The opening hours may vary. Collection of ordered goods by the customer is only possible after prior individual arrangement of an appointment with Rotau.ch. The collection appointment and the exact collection address are confirmed to the customer by Rotau.ch in advance.
4.2
The customer is obliged to collect the ordered goods independently from Rotau.ch at the agreed time. If collection does not take place on time or the customer does not appear, the customer bears all resulting disadvantages.
4.3
Rotau.ch makes the ordered goods available at a designated collection location. From the moment of provision, sole responsibility for the collection and safety of the goods passes entirely to the customer. From this moment, the customer bears the risk of loss, theft, damage or other impairment of the goods. Rotau.ch accepts no liability whatsoever for damage or losses occurring after provision.
4.4
If an order is not collected within 14 days of the agreed collection appointment, Rotau.ch is entitled to withdraw from the contract and to cancel the order. In this case Rotau.ch may freely dispose of the goods. Payments already made will be refunded to the customer exclusively in the form of a store credit, less a reasonable processing fee. Further claims for damages by Rotau.ch remain reserved.
5. Vouchers and credits
5.1 Types of vouchers
Rotau.ch may offer various types of vouchers:
– Promotional vouchers (e.g. promo codes such as «-10% on the first order»)
– Gift vouchers (available for purchase)
– Store credits (e.g. as a goodwill gesture, from returns or complaints)
Vouchers of all kinds are to be treated like cash. In case of loss, theft, unauthorised use or damage, Rotau.ch provides no replacement insofar as the balance can no longer be assigned or determined.
5.2 Promotional vouchers
Promotional vouchers are issued in the context of time-limited promotions. They may be subject to conditions (e.g. minimum order value, assortment or brand exclusions, no combinability with other discounts). The specific conditions are announced in the respective promotion.
Per order – unless stated otherwise – only one promotional voucher can be redeemed. A combination with gift vouchers or store credits is permitted.
There is no entitlement to a (partial) payout of the promotional benefit. Crediting a promotional voucher towards the purchase of gift vouchers is excluded.
If an order in which a promotional voucher was used is returned in whole or in part, the benefit granted is taken into account proportionately. If the return means that an originally required minimum order value is no longer met, the benefit is retroactively reduced accordingly.
Subsequent application of promotional vouchers to already completed orders is not possible.
Rotau.ch reserves the right to correct benefits granted in error and to refuse redemption in case of signs of misuse, forgery or unauthorised resale.
5.3 Gift vouchers
Gift vouchers are activated upon full payment and can be redeemed exclusively in the online shop at www.rotau.ch.
No discounts are granted on their purchase; they may not be used to purchase further vouchers.
Gift vouchers are transferable and valid until fully redeemed. The period of validity is five years from the date of issue, unless mandatory statutory provisions provide for a longer period.
Any remaining balance is stored on the voucher. A cash payout of the (remaining) balance is excluded, unless mandatory law provides otherwise.
Redemption takes place during the order process in the field provided for vouchers. Subsequent crediting to orders already confirmed is not possible.
If the voucher balance is not sufficient, the difference can be settled with the offered payment methods.
5.4 Store credits
Store credits arise in goodwill cases or in reversals instead of a refund.
A cash payout of the (remaining) balance of store credits is excluded.
In case of a full or partial return of an order paid with a store credit, the corresponding portion is credited again as a store credit.
Otherwise the same conditions apply to store credits as to gift vouchers. Technically, an existing store credit is applied before a gift voucher.
6. Subscriptions
6.1 Subscription order
For selected goods (e.g. regularly needed care products or refill packs), Rotau.ch may offer subscriptions. By ordering a subscription, the customer instructs Rotau.ch to supply them with the subscribed goods at the respective chosen intervals (hereinafter «subscription deliveries»). The product and shipping costs incurred with each subscription delivery are charged according to the payment method chosen by the customer.
6.2 Term and cancellation
All subscriptions at Rotau.ch are open-ended, have no minimum term and can be cancelled at any time and without giving reasons by both the customer and Rotau.ch. Cancellations can be made by email to the address provided by Rotau.ch or via any cancellation function set up on the website. Subscription deliveries that Rotau.ch has already begun processing before the cancellation was received and for which the customer has been sent a shipping confirmation will still be carried out and charged.
6.3 Price adjustment for subscriptions
The product and shipping costs may change for future subscription deliveries under the following conditions: Rotau.ch is entitled to make price adjustments insofar as Rotau.ch is affected by cost increases or cost reductions that are based on external circumstances beyond Rotau.ch's control. Such circumstances are in particular:
– changes to laws or official requirements;
– cost changes at raw material suppliers, manufacturers, suppliers, shipping service providers or external service providers;
– cost changes in production, licensing or required hardware and software;
– wage increases;
– as well as general and significant cost changes due to inflation or deflation.
Price adjustments for the goods are made exclusively to the extent of the effective cost change of Rotau.ch for the specifically subscribed goods. Rotau.ch will inform the customer of upcoming price changes to the subscribed goods in good time before the next subscription delivery by email. The customer has the right to object to the announced price change until the expiry of the period stated in the notification by cancelling the affected subscription. If no cancellation is made within the period, the price change is deemed to have been approved by the customer.
7. Payment and delivery conditions
7.1 Payment options and due date
The payment options displayed during the order process are accepted on www.rotau.ch.
For private customers (B2C), payment is made before the goods are shipped. If amounts due are not settled within 10 calendar days, Rotau.ch is entitled to claim default interest at the statutory rate and to charge reminder fees.
For commercial customers (B2B), separately agreed payment terms apply with a payment period of 30 calendar days from the invoice date. If amounts due are not settled within this period, Rotau.ch is entitled to claim default interest at the statutory rate and to charge reminder fees.
7.2 Retention of title
All delivered goods remain the sole property of Rotau.ch until full payment of the purchase price as well as all ancillary claims (in particular shipping costs, reminder fees, default interest). Before full payment, the customer is not entitled to sell, pledge, assign as security or otherwise dispose of the goods.
7.3 Delivery area
Rotau.ch generally delivers within Switzerland. Deliveries to other countries are made exclusively after prior individual arrangement and clarification of the costs incurred (cf. section 1.3).
7.4 Delivery address and partial deliveries
Delivery is made to the delivery address provided by the customer in the order process. Rotau.ch is entitled to carry out orders in partial deliveries. In this case Rotau.ch bears all additional shipping costs arising from the partial delivery.
7.5 Delivery time and delivery obstacles
Rotau.ch usually ships orders within 1–3 working days after receipt of payment. The actual delivery time depends on the chosen shipping service provider. If Rotau.ch is prevented from meeting the shipping deadline by force majeure (in particular natural disasters, official measures, strikes, pandemics, operational disruptions at suppliers or transport companies) or other circumstances for which Rotau.ch is not responsible, Rotau.ch will inform the customer without delay. If delivery becomes definitively impossible due to such circumstances, both parties are entitled to withdraw from the contract in whole or in part. Payments already made for the impossible performance will in this case be refunded without delay.
7.6 Transfer of risk
The risk of loss of or damage to the goods passes to the customer as soon as the customer or a third party authorised by the customer to receive the goods (who is not the carrier) has taken possession of the goods. In the case of self-collection, the risk passes to the customer upon provision of the goods at the designated collection location in accordance with section 4.3.
7.7 Transport damage
If goods with obvious transport damage are delivered to the customer, the customer is asked to report this immediately to the delivery service provider and to contact Rotau.ch. This serves to preserve any claims against the delivery service provider or the transport insurance. Failure to make such a complaint or contact has no effect whatsoever on the customer's statutory warranty rights.
7.8 Promotional items / free products
Rotau.ch may voluntarily enclose promotional items or free products with orders. There is no entitlement to such enclosures. If the customer exercises any right of return, the promotional items or free products received must also be returned together with the rest of the goods.
8. Returns
8.1 Exclusion from the right of return for hygienic reasons
Rotau.ch sells cosmetic and body-care products. All goods that have been opened, unsealed or put into use by the customer are excluded from the right of return for hygienic reasons. This applies in particular to all cosmetic and body-care products whose seal has been removed or whose original packaging has been opened. Also excluded from the right of return are: samples and mini versions; products from the sale or clearance; as well as products individually made or personalised according to the customer's wishes.
8.2 Return of fault-free goods
If the customer wishes to return products, they can submit a request for a return to Rotau.ch within 10 days of receiving the goods. Whether Rotau.ch agrees to such a return is solely at Rotau.ch's discretion. There is no obligation to take back fault-free goods. Any consent by Rotau.ch to a return is communicated to the customer within 48 hours. Returned products are only accepted in their original packaging and unused and undamaged. The order confirmation or the invoice must be enclosed with the return. The cost of the return is borne by the customer. In the event of an approved return, the refund is issued exclusively in the form of a store credit, unless the reason for the return is demonstrably attributable to Rotau.ch.
After receipt of the return, a quality inspection is carried out. Processing usually takes place within one week; in exceptional cases the process may take up to 14 days.
8.3 Return shipment
The customer must return the goods without delay, but at the latest within 10 days of approval of the return by Rotau.ch. The customer must avoid damage to and soiling of the goods and their original packaging. The goods must be returned including the original packaging and all accessories. The cost of the return is borne by the customer. We recommend shipping with a tracking number, as Rotau.ch accepts no liability for lost parcels.
8.4 Complaints
Please check your order immediately upon receipt. Visible damage (e.g. broken glass, damage to the packaging) must be reported within 3 days of receiving the goods, with a photo, to support@rotau.ch. In this case Rotau.ch provides free replacement or issues a store credit.
8.5 Returns in the store or at markets
Items purchased in the store or at markets can be returned within 10 days. The same quality and hygiene requirements apply as in sections 8.1 and 8.2. A return is only possible for unopened and undamaged products and upon presentation of the receipt. The refund is issued exclusively in the form of a store credit. Cash payout is excluded.

9. Storage of the contract text
Rotau.ch stores the contract text of the order, consisting of the information provided by the customer during the order process. The GTC valid at any given time can be accessed at any time at www.rotau.ch. After the order is received, the customer is sent an order confirmation with the essential details of the order to the email address they provided.
10. Liability provisions
10.1
Rotau.ch is liable exclusively for damage that Rotau.ch or its vicarious agents have caused to the customer intentionally or through gross negligence. The burden of proof for the existence of gross negligence lies with the customer.
10.2
Insofar as legally permissible, Rotau.ch's liability is limited to the typically foreseeable damage. Liability for consequential damage and lost profit is excluded.
10.3
The above limitations of liability do not apply to personal injury or to claims under the Product Liability Act. In these cases the statutory provisions apply without restriction.
11. Applicable law and place of jurisdiction
In the event of disputes, Swiss law applies exclusively. The place of jurisdiction is the ordinary courts at the registered office of Rotau Organic Shop KLG.
